Parking Regulations

General Terms and Conditions of Parking (GTC) Clouth104 Parking Garage, Seekabelstraße 2, 50733 Cologne

These General Terms and Conditions of Parking (hereinafter “GTC”) apply to rental agreements between 15min (operation) GmbH (hereinafter “Landlord”) and the respective tenant regarding the provision of a parking space for the Clouth 104 parking facility in Cologne Nippes (hereinafter “Parking Garage”). In addition to these GTC, the currently valid price list, which can be viewed at any time at the entrance area of the parking garage, shall apply. Insofar as the tenant has utilized a long-term parking card, the specific contractual provisions for long-term parkers shall apply.

The Landlord provides the Tenant with a parking space for their motor vehicle (hereinafter “Vehicle”) for a fee, in accordance with the following regulations. The Tenant has no claim to the allocation of a specific parking space. Guarding, safekeeping, or monitoring of the Vehicle, as well as the provision of insurance coverage, are not subjects of the rental agreement. Use of the parking garage is at the Tenant’s own risk. The Tenant warrants that they will use the parking garage only for the customary purposes of such a facility.

The rental agreement for a parking space is concluded between the Landlord and the Tenant upon the vehicle’s entry into the parking garage and the associated activation of the automatic license plate recognition system.

The rental prices per Vehicle are determined by the currently valid price list, which can be viewed at any time at the entrance area of the parking garage. The billing of the rental price is automated based on the recorded duration of parking. Exceeding the permitted and signposted maximum parking duration is prohibited. The Landlord is entitled to a fee corresponding to the currently valid price list until the Vehicle is removed. Any towing procedures are governed by Section 9. The rental price must be paid before exiting the parking garage, or at the latest within 48 hours after exit via the web shop (“Digital Pay Station”) or automatically upon exit via the Swavia App (registration required). In the event the Swavia App is used, the Swavia App Terms of Use shall additionally apply. Culpable violations regarding the payment of the fee shall constitute a contractual penalty for the Tenant under the conditions set forth in Section 10. After paying for the parking process in the web shop (prior to exit), the Tenant must leave the parking garage immediately. To do so, the Tenant must proceed to their Vehicle immediately after the payment process (at the latest within 10 minutes) and leave the parking garage via the exits. If the Tenant culpably remains in the parking garage longer, the rental price will be recalculated and become due starting from the time of the payment process. If the rental price cannot be paid via the web shop before leaving the parking garage, the Tenant may still pay the rental price within 48 hours after exiting. Should the payment process not be successfully completed, the Tenant must report this immediately via support@15min.io and provide their contact details and license plate number. The Tenant will promptly receive a written invoice, which must be settled within the payment period specified therein.

The Landlord is liable for personal injury, property damage, and financial loss based on and within the scope of legal regulations. They are not liable for damages caused by force majeure, such as floods, inundations, or earthquakes. The liability of the Landlord, as well as their vicarious agents and persons employed in performing their obligations, is excluded for damages caused culpably, unless the damage was brought about by intent or gross negligence. This does not apply to damages resulting from injury to life, body, or health, or to the culpable breach of essential contractual obligations (e.g., the Landlord’s obligation to provide a parking space). In the event of a breach of essential contractual obligations based on circumstances other than intent or gross negligence, liability is limited to the damage that the respective contracting party foresaw at the time the contract was concluded as a possible consequence of the breach, or should have foreseen considering the circumstances that the respective contracting party knew or should have known. Legally mandatory liability remains unaffected in any case. The Tenant is obligated to immediately report obvious damage to their Vehicle to the Landlord’s staff via the specified support email address (support@15min.io) before leaving the parking facility. This does not apply if such notification is objectively impossible or unreasonable for the Tenant. In this case, the Tenant must notify the Landlord of the damage in text form within a period of 3 days after leaving the parking garage. The Tenant is liable for all damages culpably caused by themselves, their employees, or their agents to the Landlord or third parties. In this regard, the Tenant is also liable for culpably caused contamination of the parking garage resulting from behavior that exceeds the common use of the parking garage. This includes the disposal of waste within the parking garage.

The Landlord is entitled to a right of retention as well as a statutory lien on the Tenant’s parked Vehicle due to their claims arising from the rental agreement. If the Tenant is in default with the settlement of the Landlord’s claims, the Landlord may carry out the sale of the pledge no earlier than two weeks after giving notice of such intent.

  • The following are prohibited in the parking garage:

    a. Riding bicycles, inline skates, skateboards, and similar equipment and their storage, as well as driving with trailers and the parking of trailers.
  • b. The presence of unauthorized persons without a parked Vehicle and a valid parking permit.
  • c. Smoking and the use of fire.
  • d. Performing repair and maintenance work on the vehicle.
  • e. Disturbing the neighborhood through exhaust fumes and noise, particularly by idling the engine for extended periods, testing the engine, or honking.
  • f. Refueling the vehicle.
  • g. The placement and storage of objects and waste, particularly fuel and flammable items, as well as empty fuel containers.
  • h. Remaining in the parking garage or in the parked vehicle beyond the time required for the parking, payment, and retrieval process.
  • i. Parking a vehicle with a leaking tank, oil, cooling water, or air conditioning containers, carburetors, or other substances that endanger the operation of the parking garage.
  • j. Parking vehicles that are not registered or not insured.
  • k. Unauthorized parking of vehicles outside of the parking space markings, such as in the driving lane, across two spaces, in front of emergency exits, in handicapped parking spaces (without visibly displaying a handicapped permit behind the windshield), in spaces marked as reserved, or on hatched areas.
  • l. Driving vehicles that, due to their dimensions, exceed the marked parking areas and may thereby cause an obstruction to incoming or outgoing traffic.

Upon expiration of the maximum permitted parking duration, the Landlord is entitled to remove the Vehicle at the Tenant’s expense. Prior to this, the Landlord shall request the Tenant or—if the Tenant is unknown—the owner of the Vehicle in writing, under threat of removal, to remove the Vehicle. This request is not required if the Landlord cannot identify the owner with reasonable effort, e.g., via information from the vehicle registration authority. If the Tenant parks their Vehicle contrary to the other terms of use (Section 8) outside of the parking space markings, the Landlord is entitled to relocate the Vehicle to a free and adequate parking facility at the Tenant’s expense and, should such a facility not be available, to remove the Vehicle at the Tenant’s expense. Prior to this, the Landlord shall request the Tenant or—if the Tenant is unknown—the owner of the Vehicle in writing, under threat of removal, to remove the Vehicle. This request is not required if the Landlord cannot identify the owner with reasonable effort, e.g., via information from the vehicle registration authority, or if the obstruction of the parking garage requires the immediate removal of the Vehicle.

If the Tenant culpably (intentionally or negligently) violates the obligation to pay the rental price (Section 4) and does not pay the due rental price within 48 hours after exiting the parking garage, the Tenant is obligated to pay a contractual penalty of up to 50 euros. Contractual penalties are due for payment immediately. Any claims by the Landlord that go beyond the claims mentioned in these GTC, in particular for damages and injunctive relief, remain unaffected. If a claim for damages is asserted in addition to the contractual penalty, the contractual penalty shall be offset against the claim for damages.

Should individual provisions of these GTC be or become invalid or unenforceable, or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining GTC shall remain unaffected. The Landlord is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

a. General information on the processing of personal data

As a result of a parking process, we typically process the following personal data from you:

  • Vehicle license plate

  • Start and duration of the parking process (timestamp)

  • Payment data (time of payment and type of the chosen payment method, account details, card number, further billing data)

  • In case of parking violations: Vehicle data (license plate), time and type of violation, claim data

We process this data for the following purposes:

  • Initiation, execution, and termination of the rental relationship

  • Safety and order in the parking garage

  • Enforcement of civil law claims

  • Customer service for inquiries

As a legal basis, we rely on Art. 6 Para. 1 lit. b GDPR (for contract fulfillment), Art. 6 Para. 1 lit. f GDPR (our legitimate interest, esp. prevention of abuse, assertion of legal claims, security) as well as, if applicable, Art. 6 Para. 1 lit. c GDPR (insofar as a legal obligation exists).

We store the respective data as long as we need it for the purposes mentioned above. Should the purpose be achieved, and no legal obligation for further storage exists, we will delete your personal data immediately.

As data recipients, IT service providers with whom we conclude contracts for order processing according to Art. 28 GDPR come into consideration. Other recipients of personal data may be:

 
  • Public bodies and institutions (such as tax, judicial, and law enforcement authorities) in the presence of a legal or official obligation,

     
  • Auditors, tax advisors, debt collection companies, or lawyers

b. Special processing scenarios

Below we show you some special processing scenarios:

Camera surveillance and license plate recognition The parking garage is monitored for the purpose of access control, billing, security, and to prevent abuse by means of video cameras as well as automatic license plate recognition. These purposes also constitute our legitimate interest in the data processing. The recording is made exclusively for the purpose mentioned above and on the basis of Art. 6 Para. 1 lit. b and f GDPR.

Video recordings are stored for a maximum of 72 hours, provided there are no security-relevant events. License plates are stored for the duration of the contract processing and deleted thereafter, provided there are no legal retention periods.

Use of AI for telephone support To optimize customer service, we use an AI-based support system that acts supportively during telephone inquiries. The purpose of this processing is the efficient provision of customer support, which also represents our legitimate interest in the data processing. The processing of personal data takes place here exclusively for the processing of support inquiries, according to Art. 6 Para. 1 lit. b and f GDPR.

Recording of the conversations does not take place. Furthermore, the data is not used for profiling or automated decisions within the meaning of Art. 22 GDPR.

We would like to expressly point out that an AI system may make incorrect statements. Unlike ordinary IT systems and programs, AI does not follow classic “if-then programming.” This means that a specific input into the AI system (here via direct communication) does not always result in a defined output. AI systems are “trained” using so-called machine learning processes with large amounts of data to generate independent outputs from the respective inputs. Using the example of an audio output, you can imagine the respective processing step of an AI such that your input (i.e., the word you spoke) is first converted into mathematical values in order to then calculate the mathematically most likely result for the appropriate answer. The AI is equipped with further data and information about the parking garage and calculates what the most suitable answer to your question is. Despite this additional “knowledge,” it cannot be ruled out that incorrect statements are made by the AI. We therefore ask you to always double-check the plausibility of the respective statements!
